These Terms of Use ("Terms") govern your access to and use of the FloorTek Sales Operations Management platform, including the FloorTek mobile application and the web-based dashboard located at floortekapp.com (collectively, the "Service"), operated by OX Dealer Services, LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Authorized Use

The Service is intended exclusively for authorized employees, contractors, and personnel of OX Dealer Services, LLC and its affiliated brands. Access to the Service is granted solely through authorized accounts. You must not share your login credentials with any unauthorized person. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3. Service Description

FloorTek is a sales operations management platform that provides tools for managing appointments, product configurations, pricing, offers, contracts, scheduling, team communications, and related business operations for concrete coating sales teams. The Service includes both a mobile application for field sales representatives and a web-based administrative dashboard for managers and administrators.

4. SMS/Text Messaging Terms

By using the Service, authorized personnel may receive SMS/text message notifications related to operational activities, including but not limited to offer submissions, counter offers, offer approvals, appointment updates, and system alerts.

Program Name: FloorTek Offer/Counter Offer Notifications

Program Description: Operational text notifications sent to authorized internal staff regarding offer status changes, appointment updates, and business alerts within the FloorTek platform.

Message Frequency: Message frequency varies based on operational activity. Multiple messages may be sent per day during active business periods.

Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier and service plan.

Opt-Out: You may opt out of receiving SMS messages at any time by texting STOP to any message received from the Service. You will receive a one-time confirmation message, and no further messages will be sent unless you re-subscribe.

5. Intellectual Property

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OX DEALER SERVICES, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Florida.
